Minutes of the January 15, 2009

The regular meeting of the Board of Health was called to order at 6:41 pm. by President Randy Moscaritolo who announced that the meeting was being held in conformance with the Open Public Meeting Act.� Sunshine law was read.

On roll call the following members responded as follows:

President Moscaritolo welcomed the new members.

Health Officer Ferraioli was present for this evenings meeting.� Liaison Scott Klinder was present.

A motion was made by Commissioner Forman and seconded by Commissioner Pentz to accept the previous minutes.� All in favor.

The monthly reports were discussed, approved and carried on motion by Commissioner Forman and seconded by Commissioner Ryan.� All in favor.

The monthly income and expenses for December: Income-$239.05 and Expenses-$956.62

A motion was then made by Commissioner Pentz and seconded by Commissioner Ryan to approve the finance report and pay the current bills.� Motion carried on roll call as follows:

Health Officer Ferraioli stated the 2009 Budget hearing scheduled for January 19th has to be changed due to the holiday.� The meeting was set for January 16th at 7:30 pm.

Correspondence:�

President Moscaritolo introduced the Resolution from Mayor and Council appointing new Board Members and congratulated the new members on their appointment.

New Business:

President Moscaritolo recognized the former Board Members.� Health Officer Ferraioli suggested a letter of recognition be sent to the former Board Members.

The Contract for CY2009 with Holy Redeemer was introduced by President Moscaritolo.� There was a brief discussion concerning the Contract. Commissioner Forman then made a motion and seconded by Vice President Gabriel to accept the agreement. Motion carried on roll call as follows:

There was a brief discussion concerning the ban on flavored cigarettes with the exception of menthol and clove.� The reason for the ban was the flavored cigarettes were primarily directed towards younger people.� The Health Department is required to enforce NJ Statute 2A.�� The fines are $250 - 1st offense, $500 - 2nd offense, & $1000. - 3rd offense.� The Health Department will put this notice on the Kenilworth website to inform the vendors.

The 2009 Health Fair date has been tentatively set for September 26th, 2009.�

There was a brief discussion concerning the way contracts are approved.� Union Township enters into the contract and then bills Kenilworth for their portion of the contract.� Health Officer Ferraioli stated this is the process that has been used previously.� He asked if this was the process that the Board wanted to keep.� It was agreed the procedure would remain the same as in previous years.

Old Business: �

The Mokes case has not been resolved.� REHS Grady will be going to court again due to the fact that he has not cleaned up the garbage around his house.� There were two summonses with fines of $500 and $1000.� The judge stated if the garbage was cleaned up within 10 days the summonses would be cut in half.� Mr. Mokes has not cleaned up.

The 2nd fireproof file cabinet was ordered but has not been delivered as yet.

There was a brief discussion about the x-ray analyzer which was mentioned in Health Officer Ferraioli�s monthly report.� Commissioner Forman inquired as to what this analyzer was used for.� Health Officer Ferraioli stated it was used to analyze lead content.

Commissioner Pentz inquired as to the illegal dog selling situation.� Health Officer Ferraioli stated the Health Department was not getting involved as it would be an acknowledgement of a legal business.� He stated that this is a zoning law situation.

Health Officer Ferraioli requested the Board go into closed session.� Commissioner Neuhauser made a motion and Commissioner Forman seconded to close the meeting and go into closed session at 7:29 p.m.� All in favor.� The regular meeting was re-opened at 7:38 p.m.

A motion was then made by Vice President Gabriel and seconded by Commissioner Ryan to adjourn the meeting at 7:39 p.m.

Next scheduled meeting will be February 19th at 7:00 p.m.
